Shipshe Trailers
Shipshe Trailers & Fab ("Shipshe") provides this Standard Limited Warranty on every new trailer and truck body built by Shipshe. The warranty period is 1 year from the date of sale of the trailer or truck body, or the first 12,000 miles of operation, whichever occurs first. This warranty is limited to the repair or replacement, at Shipshe's sole discretion, of parts that are found by Shipshe to be defective in material or workmanship. Except as noted below, labor is not included.
Shipshe makes no other express warranties, and no agent, employee, or representative of Shipshe has the authority to bind Shipshe to any other agreement, promise, representation, understanding, warranty or affirmation of fact concerning a trailer, except as stated in this Standard Limited Warranty. SHIPSHE DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. SHIPSHE IS NOT RESPONSIBLE FOR ANY SPECIAL, INCIDENTAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO ANY CLAIM FOR LOSS OF PROFIT, LOSS OF USE, LOSS OF TIME, OR COMMERCIAL LOSSES.
Your dealer is responsible for the terms of the retail purchase of your trailer or truck body. Please direct any concerns regarding the terms of your purchase to your dealer.
THERE ARE NO WARRANTIES WHICH EXTEND BEYOND THE DESCRIPTION ON THE FACE HEREOF. Some states do not allow limitations on how long an implied warranty lasts or the exclusion or limitation of incidental or consequential damages, so the above limitations or exclusions may not apply to you. This warranty gives you specific legal rights, and you may also have other rights which vary from state to state.
Shipshe Trailers warrants to the original purchaser that all new trailers and truck bodies, and their component parts, manufactured by Shipshe will be free from defects in material or workmanship for the warranty period defined above. It is the obligation of the owner to prove that a defect exists. Shipshe's obligation under this warranty is limited to the repair or replacement of parts that are found to be defective.
This warranty covers only those trailers and truck bodies which have been properly used and maintained as specified in the Owner's Manual, including, but not limited to, proper loading, and which have not been subject to accident, misuse, negligence, abuse, improper application, overloading, off-road or rough road use, misapplication or alteration. This warranty does not cover normal wear and tear or any product failure caused by improper loading. This warranty does not cover maintenance and normal wear items, including but not limited to, brakes and drums, tires and tubes, tarpaulins, tarpaulin hardware, lumber, suspension bushings, bushings, brake linings, seals, light bulbs, flooring paint, decals, PVC tape, bearings, rivets, fasteners or any painted or plated parts. This warranty does not cover damage caused by lack of maintenance or by the improper installation of accessories.
This warranty does not cover trailers or truck bodies on which any part has been replaced or repaired with a part not authorized by Shipshe, or which have been subject to alteration or modification, or which have had the serial number altered, defaced or removed, or which have been owned by someone other than the original retail purchaser.
Also, this warranty will be void if any part or component is subject to misuse, negligence, accident, alteration, abuse, improper loading, or overloading (whether or not the trailer or truck body is overloaded in relation to its Gross Vehicle Weight Rating). Shipshe does not authorize any person to create for Shipshe any other warranty, obligation, or liability in connection with the sale or manufacture of this trailer or truck body. No dealer, employee, or agent of Shipshe is authorized to modify this warranty.

Other exclusions from this limited warranty may be specifically set out in this document. However, this warranty is not conditioned upon the performance of any maintenance after the sale.
If a defect is discovered during the warranty period, you must report the defect to the dealer where you purchased your trailer or truck body immediately after discovery. If your dealer is unable to correct the problem, you must then contact Shipshe. For warranty service, contact:

Please have the following information available when contacting your dealer or Shipshe to report a defect:
No expenses associated with any warranty claim, such as freight, telephone, travel, meals, lodging, towing, downtime, loss of trailer or truck body or its contents, will be reimbursed by Shipshe under any circumstances.
For warranty service, you must, at your own expense, take the trailer or truck body to the dealer where you purchased the product. If the dealer is unable to correct the problem, he/she must contact Shipshe. All warranty repairs must be performed by a Shipshe authorized dealer.
The owner is responsible for the safe and proper operation of the trailer or truck body, and for providing the necessary maintenance. In the event a defect is discovered during the warranty period, it is the responsibility of the owner to take the trailer or truck body to the dealer where you purchased the product. If the dealer is unable to correct the problem, he/she must contact Shipshe.
It is also the responsibility of the owner to take the trailer or truck body for maintenance to an authorized dealer. You must present this warranty to the dealer, along with your sales invoice, at the time any warranty service is requested. Warranty service must be completed within the applicable warranty period.
SHIPSHE SHALL NOT BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, OR SPECIAL DAMAGES, INCLUDING, BUT NOT LIMITED TO, LOSS OF USE OF THE TRAILER OR TRUCK BODY, INCONVENIENCE, EXPENSE OF SUBSTITUTE PRODUCT, COMMERCIAL LOSS, PROPERTY DAMAGE, OR ANY OTHER DAMAGES. SHIPSHE'S LIABILITY SHALL BE LIMITED TO REPAIR OR REPLACEMENT OF DEFECTIVE PARTS.
In the event any part or component is defective and is covered under a warranty from the component manufacturer or another entity, that warranty is the only warranty applicable to that part or component. Shipshe makes no warranty whatsoever with regard to any such part or component. Any repairs under a component manufacturer's warranty must be made in accordance with the component manufacturer's warranty procedure. This warranty is separate from any extended warranty the dealer may have sold at the time of sale.

The warranty period is determined by the date of purchase. The purchase date is the date shown on the sales invoice.
The date of purchase is the date the trailer or truck body was first placed into service. For example, if the trailer or truck body was purchased on January 1, 2006, but not placed into service until March 1, 2006, the warranty period begins on March 1, 2006.
If you do not have a sales invoice, the date of manufacture, as shown on the trailer or truck body serial number plate, is considered the date of purchase.
The serial number of your trailer or truck body is located on the serial number plate, which is located on the front left side of the trailer or truck body, near the hitch.
This warranty shall be governed by and construed in accordance with the laws of the state of Indiana, without regard to its conflicts of law principles. Any legal action or proceeding relating to this warranty shall be instituted in a state or federal court located in Indiana.
